terms of use
the deal between you and kaimoji. plain language, no traps. by using kaimoji you agree to what is on this page.
// who we are
Kaimoji is made by KOTOPIA INC, a company based in Jamestown, North Carolina, USA. These terms cover the Kaimoji app and the website at kaimoji.app, together the "service". Reach a human at k@asgardstud.io.
// what kaimoji is
A kaomoji keyboard, a library you can browse and search, summoning (fresh kaimoji generated from your prompt), community submissions, and an optional upgrade called Kaimoji Plus.
You need to be old enough to form a binding contract where you live. If you are not, please do not use the service.
// your account
Accounts are optional. Browse and type without one if you like. If you want your favorites, XP, and history to follow you between the app and the web, sign in with Apple or with an email code.
You can delete your account yourself, in the app, at Settings then account then delete my account. Deletion is immediate and permanent. There is no grace period and we cannot undo it.
One thing to know before you press it: deleting your account removes your sign-in, your email, and your profile, but kaimoji you already contributed to the public library stay in the library, detached from you. Your account is anonymized, not your contributions erased. If you want a specific submission taken down, ask us at k@asgardstud.io before you delete, while we can still tell it is yours.
Keep your sign-in to yourself. You are responsible for what happens on your account.
// kaimoji plus
Plus is optional. It comes as a monthly subscription, a yearly subscription, or a one-time lifetime purchase. The price is shown to you before you buy, and it is the price that applies.
On iOS, Apple handles the payment. Subscriptions renew automatically until you cancel. To stop a renewal, cancel at least 24 hours before the current period ends, in App Store settings on your device. Your account is charged for renewal within 24 hours before the period ends. Refunds for App Store purchases are handled by Apple, not by us, so ask Apple.
On the web, Stripe handles the payment. Manage or cancel on your account page. Cancelling stops the next charge, and Plus stays active until the end of the period you already paid for.
Nothing that is free today moves behind the paywall later. That is a promise we intend to keep.
// what you contribute
You can submit kaimoji to the community library. When you do, you give us permission to show, store, and distribute that submission inside the service, including in the app, on the web, and in places where we present the library. You keep ownership of what you make. This permission is only so we can run the thing.
Do not submit anything unlawful, hateful, harassing, sexual content involving minors, or anything you do not have the rights to. We can remove content and suspend or close accounts for abuse. We would rather not, so please do not make us.
See something that should not be there? Report it to k@asgardstud.io and we will look at it.
// summoning and generation
The summon features generate text from what you give them. Output is provided as-is. It can be wrong, strange, or not what you wanted, and it is not unique to you. Free accounts get a daily allowance of summon actions, and the limits exist so one person cannot run up the bill for everyone.
Do not use the summon features to produce anything you would not be allowed to submit under the section above, and do not try to break, drain, or automate around the limits.
// what is ours, what is yours
The app, the site, the kaimoji brand and name, the art, and the KOTO character are ours. Please do not copy them, resell them, or pass them off as your own.
What you type with the keyboard is yours. Full stop. The keyboard does not store or transmit your keystrokes off your device. The only things that leave are the ones you explicitly ask for in the app, like summoning a kaomoji or submitting one. Details are on the privacy page.
// the boring necessary part
The service is provided as-is and as-available, without warranties of any kind, to the fullest extent the law allows. We do not promise it will always be up, always be correct, or always have the kaomoji you wanted.
To the fullest extent the law allows, our total liability to you for anything related to the service is limited to the amount you actually paid us in the 12 months before the claim. If you paid us nothing, that is the number. We are not liable for indirect or consequential losses.
Some places do not allow these limits. If you live somewhere that does not, they do not apply to you, and the rest of this page still stands.
// ending things
You can stop using the service and delete your account whenever you want. We can suspend or end access if you break these terms or if we have to for legal or safety reasons. If we ever shut the service down, we will give notice where we can.
// law and changes
These terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-laws rules.
If we change these terms we will post the updated page with a new date at the bottom. Continuing to use the service after that means you accept the change. If you do not, stop using it and delete your account.
